Nekhor Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Nekhor mobile application (“Nekhor,” “we,” “us,”, “our”, or the “app”), available on iOS and Android devices.
By downloading, accessing, or using Nekhor, you agree to be bound by these Terms. If you do not agree, do not use the app.
1. Who We Are
Nekhor is a sacred pilgrimage and Buddhist education program operated by Samye, a U.S. 501(c)(3) religious nonprofit organization.
Nekhor provides information about Buddhist sacred sites, pilgrimage guidance, maps, prayers, teachings, historical and cultural materials, and other religious and educational resources in support of Samye’s mission.

2. Eligibility
By accessing and using our App, you represent and warrant that you are at least 13 years of age. If you are between the ages of 13 and 18, you represent that you have your parent or guardian’s permission to use the App. We reserve the right to suspend or terminate your account if we believe you are under the minimum required age.
If you use Nekhor on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. Accounts
To access certain features, you may need to create an account. You are not required to create an account to subscribe; you may subscribe anonymously as described in Section 4 (Subscription and Payments) below.
You agree to:
Provide accurate and complete information
Keep your login credentials secure
Be responsible for all activity under your account
You may not share or transfer your account to another person without our permission.
We may suspend or terminate accounts that violate these Terms or are used in a harmful or unlawful manner.
4. Subscription and Payments
Some features of Nekhor require a paid subscription. You may choose to subscribe anonymously, without creating a Nekhor account; anonymous subscriptions are processed entirely through the Apple App Store or Google Play Store and are not linked to any personal identifier on our systems.
Subscriptions are managed through the Apple App Store or Google Play Store
Payments are processed by Apple or Google, not directly by Nekhor
Subscription status is verified via third-party services such as RevenueCat
Pricing and billing terms are displayed at the point of purchase
All payments are non-refundable except where required by applicable law or the policies of Apple or Google.
Subscriptions renew automatically unless canceled through your app store settings.
5. License to Use the App
We grant you a limited, non-exclusive, non-transferable, revocable license to use Nekhor for personal, non-commercial, and spiritual or educational purposes, in accordance with these Terms.
You may not:
Copy, modify, distribute, or sell any part of the app
Reverse engineer or attempt to extract source code
Use Nekhor for commercial exploitation without permission
Use the app in a way that interferes with its operation or security
All rights not expressly granted are reserved by Nekhor and Samye.
6. Religious and Educational Nature of Content
Nekhor is a religious and educational application.
Content provided in the app, including teachings, pilgrimage information, prayers, and descriptions of sacred sites, is intended for spiritual practice, education, and cultural understanding.
Use of the app does not create any religious obligation, membership, or formal spiritual commitment unless explicitly stated by Samye in other contexts.
7. User Conduct
You agree not to use Nekhor to:
Violate any applicable law or regulation
Harass, abuse, or harm others
Upload or transmit malicious code or interfere with app functionality
Attempt unauthorized access to systems or data
Misrepresent your identity or affiliation
Use the app in a way that undermines its religious or educational purpose
We reserve the right to remove access for conduct that we determine is harmful or inappropriate.
8. Intellectual Property
All content in Nekhor, including but not limited to text, teachings, translations, maps, images, audio, video, app design, structure, and branding, is owned by or licensed to Nekhor, Samye, or their respective rights holders and is protected by intellectual property laws. These assets are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. All trademarks, service marks, and logos used within the app are the property of their respective owners.
Nekhor may include materials that are owned by third parties. Such materials are used with permission, under license, or as otherwise permitted by law (including fair use or similar doctrines where applicable). These third-party materials remain the sole property of their respective owners.
Where third-party content is included, Nekhor may provide attribution or “courtesy” notices. Such attribution does not imply an endorsement by Nekhor, ownership or transfer of rights.
You may use the app and its content solely for personal, non-commercial, educational, and spiritual purposes as intended within the app. You may not reproduce, distribute, modify, or publicly display any content from Nekhor outside the app unless expressly permitted in writing by the applicable rights holder or allowed by law.
All rights not expressly granted are reserved by Nekhor, Samye, and their licensors.
9. Third-Party Services
Nekhor relies on third-party services, including:
Apple (App Store, Sign in with Apple)
Google (Google Sign-In, Maps, Play Billing)
RevenueCat (subscription management)
Heroku (Salesforce) (backend hosting)
Amazon Web Services (AWS) (cloud infrastructure)
We are not responsible for the availability, content, or practices of third-party services, which are governed by their own terms.
10. Availability and Changes
We may modify, update, or discontinue any part of Nekhor at any time.
We do not guarantee uninterrupted or error-free operation of the app.
We may also update these Terms from time to time. Continued use of Nekhor after changes become effective constitutes acceptance of the revised Terms.
11. Termination
We may suspend or terminate your access to Nekhor at any time, with or without notice, if:
You violate these Terms
We are required to do so for legal or security reasons
We discontinue the app or certain features
You may stop using Nekhor at any time.
Upon termination, your license to use the app ends immediately.
12. Disclaimer of Warranties
Nekhor is provided on an “as is” and “as available” basis.
To the fullest extent permitted by law, we disclaim all warranties, including:
Accuracy or completeness of content
Availability or reliability of the app
Fitness for a particular purpose
Non-infringement
We do not guarantee that the app will meet your expectations or be error-free.
13. Limitation of Liability
To the fullest extent permitted by law, Nekhor and Samye shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the app.
This includes, without limitation:
Loss of data
Loss of access
Spiritual or personal decisions made based on app content
Technical failures or interruptions
Some jurisdictions do not allow certain limitations, so these limitations may not apply to you in full.
14. Indemnification
You agree to indemnify and hold harmless Nekhor, Samye, and their affiliates from any claims, damages, liabilities, or expenses arising from:
Your use of the app
Your violation of these Terms
Your violation of applicable laws or third-party rights
15. Governing Law
These Terms are governed by the laws of the United States and, where applicable, the State in which Samye is established, without regard to conflict of law principles.

Additional Terms for Apple App Store Users
The following additional terms apply if you obtained the Nekhor mobile application (the "Licensed Application") from the Apple App Store. These terms are in addition to Nekhor’s Terms of Use above; if there is a conflict between these Apple-specific terms and the terms above, these Apple-specific terms control with respect to your use of the Licensed Application on Apple-branded devices.
Acknowledgement
You and we acknowledge that these Terms of Use are concluded between you and Nekhor / Samye only, and not with Apple, Inc. ("Apple"). Nekhor / Samye, not Apple, is solely responsible for the Licensed Application and its content. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.
2. Scope of License
The license granted to you for the Licensed Application is limited to a non-transferable license to use the Licensed Application on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the Licensed Application may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.
3. Maintenance and Support
Nekhor / Samye is solely responsible for providing any maintenance and support services with respect to the Licensed Application, as specified in these Terms of Use, or as required under applicable law. You and we acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.
4. Warranty
Nekhor / Samye is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you (if applicable); to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Nekhor / Samye.
5. Product Claims
You and we acknowledge that Nekhor / Samye, not Apple, is responsible for addressing any claims relating to the Licensed Application or your possession and/or use of the Licensed Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the Licensed Application's use of the HealthKit and HomeKit frameworks (if applicable).
6. Intellectual Property Rights
You and we acknowledge that, in the event of any third party claim that the Licensed Application or your possession and use of the Licensed Application infringes that third party's intellectual property rights, Nekhor / Samye, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
7. Legal Compliance
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

9. Third Party Terms of Agreement
You must comply with any applicable third-party terms of agreement when using the Licensed Application (for example, your wireless data service agreement).
10. Third Party Beneficiary
You and we acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms of Use, and that, upon your acceptance of the Terms of Use, Apple will have the right (and will be deemed to have accepted the right) to enforce the Terms of Use against you as a third-party beneficiary thereof.
